📌 RA 8042 (Migrant Workers and Overseas Filipinos Act of 1995) Section 51 – “Free Placement”

This section states that recruitment agencies are prohibited from charging placement fees to Filipino workers for overseas employment, except in cases allowed by the POEA (now DMW).

📌 RA 10022 (2010 Amendment)
This strengthened the rule by stating that

Filipino household service workers (HSWs)

must not be charged ANY placement fees at all.     

🧭 What This Means in Practice
Under RA 8042 and RA 10022:
No placement fees for most OFWs
No processing fees for HSWs
Recruitment agencies cannot charge “training fees,” “documentation fees,” or “processing fees” disguised as placement fees

Only professional/technical workers may be charged placement fees,

but only up to one month’s salary, and only if the receiving country allows it.
